1. Reference to "Palmerbet", “we” “our” or “us” is a reference to Palmerbet the trading name of Palmer Bookmaking Pty Limited ABN 89154794411a company incorporated in Australia under the Corporations Act 2001(Cth). Palmerbet is licenced in New South Wales to accept bets by telephone and via the Palmerbet website.
2. Reference to "you", "your" or the "customer" is reference to any person using the Website or the services of Palmerbet and/or any registered customer of Palmerbet.
3. Internet gambling may be illegal in the jurisdiction in which you are located. If so, you are not entitled to have an account with Palmerbet.
4. It is the responsibility of every person to know the laws concerning online gambling within the country of their domicile.
5. Minors are not permitted to gamble. Bets cannot be placed on behalf of minors.
6. By opening a Palmerbet Betting Account or placing a bet with over the telephone or via the Palmerbet website, you are deemed to be acquainted with and agree to be bound by :-
b. The Additional Terms applicable to declared Betting Events Bets with Palmerbet set out below, collectively referred to as the Terms and Conditions (the “Terms”) so please read them carefully.

B. THE ADDITIONAL TERMS APPLICABLE TO DECLARED BETTING EVENTS BETS WITH PALMERBET
1. CUSTOMER RESPONSIBILITY
1.1 A "Customer" is a natural person who is 18 years or older who has a Palmerbet Betting Account. Customers are responsible for ensuring that their records, in particular address, telephone number, email address and payment/bank details, are kept up to date. In the event that a Customer has not kept their records up to date, Palmerbet reserves the right to suspend the Account. Customers are limited to holding a maximum of one account at any one time.
1.2 It is the Customer's responsibility to ensure that they keep their password PIN and other pieces of personal information confidential. If a Customer has concerns regarding a breach of security, they should notify Palmerbet immediately whereupon new details may be given. Upon notification of the new details, Palmerbet reserves the right to invalidate any future transactions which utilise the previous details.
1.3 The Customer will be responsible for all bets in which their password PIN and other pieces of personal information are used for any activity on his Customer Betting Account.
1.4 Any bet made by telephone or via the Internet where the password PIN and other pieces of personal information have been used will be regarded by Palmerbet as being valid and may not be changed, cancelled or modified unless so agreed by Palmerbet in its absolute discretion.
2 CUSTOMER IDENTIFICATION AND VERIFICATION
In line with all Australian Financial Institutions under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (C’wlth) (“AML Act”) all Palmerbet Betting Account holders are required to provide Palmerbet with adequate identification for the purposes of complying with the Act. The provisions of the Act provide for Australian Government standards of identification for proof of name, age and residential address.
All clients consent for Palmerbet to disclose your name, residential address and date of birth to a credit reporting agency and ask the credit reporting agency to provide an assessment of whether the personal information so provided matches (in whole or in part) personal information contained in a credit information file in the possession or control of the credit reporting agency to assist in verifying your identity for the purposes of the Anti-Money Laundering and Counter-Terrorism Act 2006. The credit reporting agency may prepare and provide Palmerbet with such an assessment and may use personal information including the names, residential addresses and dates of birth contained in credit information files of you and other individuals for the purposes of preparing such an assessment.
“Identification Details” (ID) means the Customer’s Name, Address and Date of Birth, as provided to Palmerbet upon registration. After registering with Palmerbet, Palmerbet will automatically and on behalf of the Customer, supply the Customer’s Identification Details to a third-party organisation for the purpose of ID verification. If this process is unsuccessful, Palmerbet offers Customers methods of complying with the government regulations.
OPTION 1: AUTOMATIC VERIFICATION - AUSTRALIAN CITIZENS ONLY
Uses the secure service of Edentity to provide an assessment of whether the personal information provided matches (in whole or in part) personal information contained in a credit information file in the possession or control of the credit reporting agency to assist in verifying your identity
If this method is unsuccessful we will send you an email stating that this method failed.
OPTION 2: ONLINE VERIFICATION – AVAILABLE TO AUSTRALIAN CITIZENS ONLY
Our online identity verification system is for Australian Customers’ use only. Go to the My Account section of the Palmerbet website and click on Verify Me. To make the process easier, we recommend that you have with you any of the following pieces of information:
i. Your Drivers Licence;
ii. Your Medicare Card;
iii. Your Australian Passport.
Please note that Palmerbet does not have access to this information as it is collected by a government authorised body for the purposes of complying with Australian Government legislation. In agreeing to use our online verification, all Customers consent to have their name, date of birth and/or recorded address passed to the
government agencies selected for the purposes of their identification verification.
OPTION 3: VERIFICATION USING CERTIFIED DOCUMENT COPIES
Download, print, and complete the Identity Verification Form
We require a certified true copy of either:
i. A current driver’s licence showing current address, photo and date of birth OR
A passport and a Utility provider’s statement or invoice, which has been issued within the preceding three months (showing your current name and address).
ii. Clear legible copies should be made of the original documents.
iii. Customers should print their name and PIN on the copies of the original documents and sign the documents in front of the Certifier.
iv. The Certifier should then state "I certify that this copy is a true copy of the original document that I have sighted”.
v. The Certifier should sign and date the documents and include their:
- Full Name
- Work telephone and mobile number
- Capacity of Certification
Palmerbet reserves the right to ask for additional information to be supplied if the copies are illegible/unclear, or if we need further information in compliance with government legislation. Failure to provide verification of your identity will result in closure or suspension of your Palmerbet Betting Account.
After the Palmerbet Account opening process has been completed, your Palmerbet Account can be used immediately to make deposits and place bets.
You acknowledge that your Palmerbet Account will be blocked for withdrawals and that you cannot close your Palmerbet Account until "Membership Verification" has been processed and approved.
You agree that your Palmerbet Account will be frozen if "Membership Verification" is not achieved by us within 30 days from the day on which your Palmerbet Account was opened.
You agree that Palmerbet is not liable if your account remains unverified after 30 days due to a system fault or any other reason
You acknowledge that your Palmerbet Account will only be unfrozen within a reasonable period of time after Palmerbet has received and approved the required identification documentation.
Where Palmerbet reasonably considers that either you or your Palmerbet Account transaction history may represent a significant risk to Palmerbet's betting business and/or its exposure to breach of the AML Act, Palmerbet may:
a. request further information from you;and/or
b. freeze your Palmerbet Account at any time and without prior notice to you; or
c. close your Palmerbet Account permanently and without prior notice to you.
You agree that in order to assist Palmerbet to make this assessment, Palmerbet may disclose your personal information to third parties, such as, but not limited to, law enforcement agencies, both in Australia and overseas and “World Check” assessment services.
You agree that where Palmerbet elects to immediately freeze or close your Palmerbet Account, based on its assessment of the risk to Palmerbet's betting business and/or its exposure to breach of the AML Act, Palmerbet will give you 30 days in which you can request that Palmerbet reverses its decision. Your request must be made in writing to Palmerbet Management, PO Box 1036 Cronulla NSW 2230, and be accompanied by relevant supporting documentation.
If a Palmerbet Betting Account is suspended all bets will stand.
3 PALMERBET’S RESERVED RIGHTS
3.1 Palmerbet reserves the right to cancel or refuse any bet or part of a bet without giving a reason at any time if any one or more of the following occur:
(i) the Customer is less than 18 years of age;
(ii) the Customer is betting on behalf of a person who is less than 18 years of age; and/or
(iii) the Customer is in breach of these Terms.
3.2 Palmerbet cares strongly for its public reputation and does not permit persons under the age of 18 years to hold an account. If a customer's children have access to the computer you are using to log into Palmerbet's Internet service, we encourage you to install a child protection software package (e.g. Cyber Patrol, Net Nanny).
3.3 Palmerbet reserves the right to close a Customer Betting Account and refund the credit balance without further explanation. In this event, outstanding bets will be honoured unless Palmerbet declares otherwise.
3.5 Palmerbet reserves the right to provide Australian governing sporting bodies, upon their request, with:
(i) records or documents in the possession or control of Palmerbet (excluding bank account details, credit card details and government identifiers) relating to betting transactions of the Customer; and
(ii) the names, contact details and similar identifying information in the possession or control of Palmerbet relating to Customer's who have entered into betting transaction(s) after September 1, 2006.
Such information will only be provided to assist in a legitimate inquiry conducted by the Australia governing sporting body to maintain the integrity of the sport. For the avoidance of doubt, the Customer consents to Palmerbet providing the above information to an Australian Governing sporting body. "Australia governing sporting bodies" means organisations charged with the administration of a sport throughout Australia.
3.6 The Customer acknowledges that Palmerbet may be required by law to disclose the Customer's identity and details of its Customer Betting Account and the Customer agrees that Palmerbet cannot be liable to the Customer in any way if it makes a disclosure it is obliged by law to make.
3.8 Notwithstanding anything contained elsewhere in these Terms, Palmerbet will not be liable for any errors in respect of bets including where Palmerbet has
(i)incorrectly stated the relevant betting information for any sporting event, such as posting wrong dividends or lines,
(ii) continues to accept bets on closed or suspended markets; or
(iii) incorrectly calculates or pays a settlement amount.
If the error is identified prior to the commencement of the event and notified by Palmerbet to the most recent telephone or facsimile contact number or email address supplied by a Customer, whose bet on that event has been accepted or confirmed by Palmerbet, such bets will be void. If the bet is part of a multiple bet, the bet will then be re-calculated without the team/competitor which had the human error;
If the error is identified only after the commencement of the event or for any other reason not notified to the Customer's point of contact prior to commencement of the event, the bet on the event shall stand. The only exception to this is where Palmerbet can demonstrate that the error was manifest or obvious, or that the Customer otherwise should reasonably have been aware of the error, when the bet was placed.
If a Customer has been paid winnings in error Palmerbet shall be entitled to issue the Customer with an invoice demanding repayment. In such circumstances, the invoice shall be evidence that the amount is due and payable.
3.9 Palmerbet has made considerable efforts to ensure its sports betting business operates in a fair, prompt and accurate manner. Except to the extent permitted by law (and only to such an extent), Palmerbet excludes all warranties (express or implied) relating to its sports betting business and shall not have any liability for direct, indirect or consequential loss, damage, expense or injury suffered by any Customer.
3.10 Palmerbet's liability in respect of any claim or loss shall be limited in amount to the relevant bet placed by a Customer.
3.11 Palmerbet reserves the right to void any or all bets made by any individual or group of people acting together (or on behalf of another individual or group of people) in an attempt to gain financial benefit through the manipulation of tote based dividends or official starting prices. This can include persons, relatives, organisations, Palmerbet and their employees.
3.12 All bets are considered to be placed and received in the New South Wales in the Commonwealth of Australia.
3.13 Palmerbet does not warrant or imply that participation in bets complies with the legal requirements of any state or country other than New South Wales. A Customer must satisfy them self and assume full responsibility for the legality of:
(i) Applying to Palmerbet for a Customer Betting Account;
(ii) Remitting funds by credit card or other permitted means to a Customer Betting Account held with Palmerbet;
(iii) Placement of bets with Palmerbet and,
(iv) Receiving payments from Palmerbet.
3.14 A Customer may only have one (1) Customer Betting Account. If a Customer has additional Customer Betting Account(s), then
(i) the account balances of all associated Customer Betting Accounts may be transferred into the original Customer Betting Account and; if, after the transfer(s) the original Customer Betting Account has a debit balance, then Palmerbet shall be entitled to receive payment for the debit balance immediately or,
(ii) if, after the transfers there is a credit balance in the original Customer Betting Account, the credit balance will be held by Palmerbet until such time as a determination has been made by Palmerbet as to whether or not there has been a breach of these Terms.
3.15 These Terms shall be governed by and construed in accordance with the laws of the New South Wales and each Customer irrevocably submits to the exclusive jurisdiction of the New South Wales Courts in respect of any dispute or matter arising from these Terms.
3.16 The regulatory authority is Racing NSW or such other authority authorized by the laws of the New South Wales for that purpose.
3.17 If a Customer receives a bonus that requires a deposit to be made to claim the bonus, both the deposit and the bonus must be wagered. Palmerbet reserves the right to remove the bonus and refund the remaining balance should a Customer be in breach of these conditions.
3.18 Palmerbet reserves the right to withhold funds from Customers who have not completed the identification process. Funds will be released as soon as this process has been completed.
3.19 Palmerbet reserves the right to refuse any bet in its discretion and without giving a reason.
3.20 Palmerbet is entitled to make a recording of each telephone discussion.
3.21 Palmerbet ensures every effort is undertaken to provide accurate and timely information, however due to information being provided by third parties Palmerbet accepts no responsibility for the accuracy of the information found on this website.
3.22 While Palmerbet uses reasonable care to provide betting facilities operated via the Palmerbet betting systems, due to technological limitations Palmerbet does not promise that the system will be fault free. If Palmerbet is in breach of these Terms and Conditions or acts negligently, its liability will be determined under the principles applied by the courts in NSW. Palmerbet is not liable to the Customer for any loss to the extent that it is caused by the Customer for example, through the Customer’s negligence or breach of these Terms.
3.23 Palmerbet may adjust account balances where permitted to do so in accordance with the Betting Rules, including, for example, where a dividend or refund has been miscalculated.
3.24 Palmerbet reserves the right to impose other conditions of use or vary these Terms and Conditions from time to time for reasons including changes in regulatory requirements, changes in the law, changes in product types and changes in Palmerbet’s systems. Palmerbet will notify the Customer in writing, by email and/or via its website, where Palmerbet reasonably believes that the additional conditions or variations of these Terms will cause material detriment to the Customer.
(i) does not guarantee that it will accept all bets placed through Palmerbet betting systems;
(ii) reserves the right to change the method of operating the Palmerbet betting systems or its method of receiving or accepting bets at any time. Where practicable, Palmerbet will try and tell the Customer about any changes beforehand, such as on www.palmerbet.com; and
(iii) reserves the right at any time to void any and all bets that in any way contravene one or more of the Betting Rules or Terms.
4. TERMS UNDER WHICH WAGERS ARE ACCEPTED
4.1 A Customer must be 18 years of age or older.
4.2 Bets will be accepted up to the advertised start time of the event or such earlier time as dictated by Palmerbet specified on the website at the event page. If a bet is inadvertently accepted in respect of an event after it starts, at the discretion of Palmerbet the bet may be deemed to have been made invalidly and will be refunded to the Customer.
4.3 A Customer should check its Customer Account Balance each time it logs on to its Customer Betting Account or at the time it places a bet via the telephone. In the event a Customer account balance is queried or disputed, it is the Customer's responsibility to notify Palmerbet at the earliest opportunity and provide the Customer's own record of transactions since the Customer Account Balance was last verified. If no formal dispute is lodged by a Customer with Palmerbet for a period of 14 days, it is assumed that the Customer has accepted that his balance is correct and in order.
4.4 When making a bet via telephone it is the Customer's responsibility to quote the correct user-name and Personal Identification Number (PIN).
4.5 When making a bet via the Internet, it is accepted when the Customer submits the bet and a confirmation and betting reference number is issued through the Palmerbet website.
4.6 Palmerbet shall not accept any bet by telephone made in relation to thoroughbred, harness and greyhound races or approved sporting events where the bet is less than $20.00.
4.7 The minimum bet via the Internet is AUD$1.00.
4.8 Palmerbet shall make a recording of each telephone discussion with a Customer when a Customer is placing a bet, or lodging a dispute or a query on its account. The Customer acknowledges this and agrees to such recordings being made and, where a dispute occurs which cannot be resolved by Palmerbet, the Customer agrees that the relevant recording(s) and/or any records of a Customer's transactions via the Internet may be made available to the regulatory authority to enable the dispute to be determined in accordance with these Terms.
4.9 A Customer is unable to cancel or change a bet once the bet has been placed and the acceptance confirmed unless Palmerbet specifically states otherwise.
4.10 All wager prices/lines may be subject to variation.
4.11 Palmerbet provides a voluntary self exclusion program within the My Account section, enabling customers to set self imposed restrictions on their accounts. A customer wishing to restrict maximum bet limits on their accounts can contact Palmerbet via the Contact Us section and restrictions can be applied to individual accounts.
4.12 Palmerbet reserves the right to restrict a Palmerbet account to telephone bets only without notice and without giving a reason.
5. LAWFUL USE OF PALMERBET ACCOUNTS
5.1 You agree that as the Palmerbet Account holder, you are the only permitted person to use your Palmerbet Account.
5.2 For your own protection, Palmerbet may require you to provide further information to prove your identity, refuse to accept bets, refuse to permit withdrawal of funds or refuse to accept other transactions if Palmerbet becomes aware or reasonably believes that the person seeking to place bets on or withdraw funds from your Palmerbet Account may not be you.
5.3 You can make deposits to your Palmerbet Account by credit card, BPAY, POLi, cheque or EFT. You agree that if you make deposits to your Palmerbet Account by cheque and any such cheque is dishonoured, then Palmerbet may debit from your Palmerbet Account a fee of up to $16.50 (including GST) per dishonoured cheque.
5.4 Use of Palmerbet betting facilities in violation of any Federal, State or Local laws is prohibited.
5.5 You agree to notify Palmerbet, as soon as practical, if your address or other contact details change, or you lose or have your Palmerbet Account card stolen. Upon notification of any lost or stolen Palmerbet Account card, Palmerbet will:
(i) Invalidate your lost or stolen card; and
(ii) Issue you with a new card.
5.6 You agree that until such time as you have notified Palmerbet of your lost or stolen card, and/or unauthorised use of your user name and password to your Palmerbet Account, Palmerbet will assume that all Palmerbet Account activity has been conducted by you, and, therefore, you will bear any losses suffered due to such unauthorised use.
5.7 If Palmerbet has formed the reasonable belief that you have been unlawfully using your Palmerbet Account, you acknowledge that Palmerbet may report such belief to one or more government agencies, including law enforcement agencies or racing or sporting bodies without prior notice to you.
5.8 If Palmerbet has formed the reasonable belief that a transaction on your Palmerbet Account has occurred by any person other than you, Palmerbet may decide, at its sole discretion and taking into Account the circumstances in which the transaction occurred, to cancel any such bet and refund the bet to your Palmerbet Account, and if appropriate, disclose details of the transaction, the Palmerbet Account and the Palmerbet Account holder to government agencies, including law enforcement agencies or racing or sporting bodies.
5.9 If you have entered the Palmerbet website by clicking through from another website (on this or a previous occasion), Palmerbet may pay a commission to the operator of that website in relation to the opening and/or use of your account. You acknowledge and assent to this commission being paid.
Palmerbet will only accept cash deposits to your Palmerbet Account in person on course where Palmerbet is fielding. Palmerbet generally fields oncourse in the Sydney betting ring at most Metropolitan races.
No bet stands until the operator has called it back to you and confirmed it. Once placed, not bet may be altered or cancelled.
You acknowledge that all telephone calls made to an Operator and to Palmerbet Customer Service are recorded for regulatory, quality and verification purposes. The Customer acknowledges this and agrees to such recordings being made and where a dispute occurs which cannot be resolved by Palmerbet, the Customer agrees that the relevant recordings and/or any records of a customer’s transactions via the Internet may be made available to the regulatory authority to enable the dispute to be determined in accordance with these Terms.
When placing a bet on the telephone it is the customer’s responsibility to quote the correct user name and PIN. Betting bonuses cannot be used on live betting.
No bet stands until you have received an ‘’Accepted” message when your bet is processed through our website. Once processed no bet may be altered or cancelled by the customer.
You may only use Palmerbet website and the material on it for personal use.
7.DEPOSITS AND WITHDRAWALS FROM YOUR PALMERBET ACCOUNT
You may only make credit card deposits by Internet or telephone using MasterCard or VISA.
The credit card nominated for the deposit of credit card funds to your Palmerbet Account must be in the same name as your Palmerbet Account, unless Palmerbet otherwise agrees and you have first supplied Palmerbet with the following details:
a. A written and signed authority from the third party card holder authorising the use of their credit card;
b. Photo Identification from the credit card holder for example Drivers licence or passport; and
c. A copy of the front and back of the credit card as per our Credit Card Verification Terms and Conditions.
d. If Palmerbet agrees that you may use a third party's credit card (that you are not the named owner of) you will be required to supply Palmerbet.com with the following:
(i) A written and signed authority from the card holder authorising the use of their credit card;
(ii) Photo Identification from the credit card holder for example Drivers licence or passport; and
(iii) A copy of the front and back of the third party credit card in accordance with Palmerbet's Credit Card Verification Terms and Conditions.
For the purposes of payment to your Palmerbet Account (but not any Credit Betting Facility attached to your Palmerbet Account), you acknowledge, that in order to protect your credit card details, you will black out all digits, including the CCV on the back of the credit card, except for the first six digits and the last four digits which must be clearly visible, before you send any credit card details to Palmerbet.
Palmerbet will notify you of the minimum deposit required and the maximum deposits permissible for your Palmerbet Account, which amounts may be varied by Palmerbet from time to time, by you contacting Customer Services on either 1300 12 HELP or Customer Services (direct) on +61 2 9571 0010 or by visiting www.palmerbet.com.
Palmerbet will operate in accordance with the Payment Card Industry Data Security Standard in the collection, use, disclosure and storage of your credit card information.
You may make any number of credit card account transactions per day, within the maximum total deposit limit.
You cannot withdraw any deposits made by credit card or any other method until the deposit amount has been turned over except where you are unable to turn over deposit amounts due to the closure, suspension or restriction of the betting services, or otherwise due to its breach of these Terms or its negligence.
A Client must turnover any funds deposited into their Palmerbet account ONCE (x1). If a client fails to do so, any fees associated to the deposit and withdrawal will be passed onto the client.
Palmerbet will not apply any fees for deposits into your Palmerbet Account unless turnover requirements are not met.
Palmerbet may determine whether to accept or reject any credit card transactions from any customer in its sole and absolute discretion.
If a client uses their Credit / Debit card to fund the account, the equivalent of the amount received off each card must be refunded back to that same card from future winnings
Palmerbet reserves the right to withhold any funds until a client provides proof of a funds transfer.
Palmerbet may charge an additional 'verification amount' betetween 1 and 100 cents on a credit card deposit to certify the identifty of the cardholder. This additional charge will be credited to a users account when the card is validated through the my account section website.
8. CLOSURE SUSPENSION OR RESTRICTION OF A PALMERBET ACCOUNT
By your election
You may close, suspend or restrict your Palmerbet Account at your election by notifying Customer Services via email at email@example.com
At Palmerbet's election
Palmerbet may suspend the operation of your Palmerbet Account to investigate transactions in respect of your Palmerbet Account if Palmerbet:
(a) becomes aware or reasonably believes that your Palmerbet Account has:
(i) suspicious transactions which might be fraudulent;
(iii) been misused;
(iv) been subject to unauthorised use; and/or
(b) is directed by a government regulator or racing or sporting body to do so.
You acknowledge that Palmerbet has obligations to its employees to provide a safe work environment amongst other legal duties, and so you agree that Palmerbet may, at its election, close your Palmerbet Account in circumstances where Palmerbet forms the view that you act or have acted unreasonably towards Palmerbet and/or its agents, in the course of betting transactions, which conduct, either singular or repeated, includes:
(a) offensive language;
(b) aggressive behaviour;
(c) overt racial remarks;
(d) overt sexual remarks;
(e) harassing remarks;
(f) attempted or actual bullying;
(g) threatening remarks made against Palmerbet, its property, yourself and/or third persons; and
(h) other similarly unacceptable anti-social behaviour.
Palmerbet may, at its sole discretion, restrict, suspend and/or close your Palmerbet Account where Palmerbet forms the reasonable view that:
(a) you are less than 18 years old;
(b) you are betting on behalf of another person (including someone who is less than 18 years old);
(c) you have not acted in good faith in your dealings with your Palmerbet Account, including suspected fraudulent activity or collusion;
(d) you are in breach of any laws (including the AML Act);
(e) the person conducting transactions on your Palmerbet Account is not you;
(f) you are intoxicated and/or under the influence of drugs;
(g) you are a self-excluded customer;
(h) you suffer from a mental impairment;
(i) based on statements made by you, either singular or repeated, you may not be gambling responsibly;
(j) you have acted unreasonably towards Palmerbet operators;
(k) your betting activity or intended betting activity will result in Palmerbet taking on an unreasonable commercial risk; or
(l) you are in material breach of these Terms or the Betting Rules.
In the event that Palmerbet closes your Palmerbet Account at its election, Palmerbet will:
(a) refund the balance of your Palmerbet Account;
(b) declare void any bonus bet credits or account top ups which will not be returned to the customer; and
(c) honour all outstanding bets,
If Palmerbet restricts, suspends and/or closes your Palmerbet Account, Palmerbet will make all reasonable efforts to notify you via the contact details registered with your Palmerbet Account and may provide its reasons for restricting, suspending and/or closing your Palmerbet Account.
You agree that where Palmerbet elects to restrict, suspend or close your Palmerbet Account, Palmerbet will give you 5 days to request that Palmerbet changes or reverses its decision. Your request must be made in writing to Palmerbet Management, PO Box 1036 CronullaNSW 2230, and be accompanied by relevant supporting documentation.

10. PRIVACY ACT 1988
10.1 The Customer agrees that the Personal Data provided may be retained by the Palmerbet and used by related entities for marketing purposes, for the purposes set out below and to provide to any entity which conducts an event on which a Customer places a bet.
10.2 The Customer agrees for the Palmerbet to obtain from a credit-reporting agency a credit report containing personal credit information about the Customer in relation to credit provided by the Palmerbet.
10.3 The Customer agrees that the Palmerbet may exchange information about the Customer with those credit providers named in the Application for Credit account or named in a consumer credit report issued by a reporting agency for the following purposes:
10.3.1To assess an application by Customer;
10.3.2To notify other credit providers of a default by the Customer;
10.3.3To exchange information with other credit providers as to the status of this credit account, where the Customer is in default with other credit providers; and
10.3.4To assess the credit worthiness of the Customer.
10.4 The Customer consents to the Palmerbet being given a consumer credit report to collect overdue payment on commercial credit (Section 18K (1)(h) Privacy Act 1988).
10.5 The Customer agrees that Personal Data provided may be used and retained by the Palmerbet for the following purposes and for other purposes as shall be agreed between the Customer and Palmerbet or required by law from time to time:
10.5.1 provision of Betting Accounts;
10.5.2 marketing of Betting Accounts by the Palmerbet, its agents or distributors in relation to the Betting Accounts;
10.5.3 analysing, verifying and/or checking the Customer's credit, payment and/or status in relation to provision of Betting Accounts;
10.5.4 processing of any payment instructions, direct debit facilities and/or credit facilities requested by Customer; and
10.5.5 enabling the daily operation of Customer's account and/or the collection of amounts outstanding in the Customer's account in relation to the Betting Accounts.
10.6 The Palmerbet may give, information about the Customer to a credit reporting agency for the following purposes:
10.6.1to obtain a consumer credit report about the Customer; and or
10.6.2allow the credit reporting agency to create or maintain a credit information file containing information about the Customer.
1 Winnings will be credited to a Customer's Betting Account following confirmation of the official result; once Palmerbet has paid out it will not recognize the overturning of an events decision. Should funds be credited to a Customer's Betting Account in error, it is the Customer's responsibility to notify Palmerbet of the error without delay and the Customer shall return to Palmerbet any funds credited in error.
2Customer Betting Accounts:
2.1 Each Customer will be issued a Customer Betting Account before wagers are accepted.
2.2 With the approval of Palmerbet a Customer's Betting Account will be granted a Maximum Debit Limit.
2.3 A Maximum Debit Limit is the maximum permissible debit balance.
2.4 Palmerbet and the Customer are required to settle the "Customer Account Balance".
2.5 Subject to paragraph 10.2.2 above a "Customer Account Balance" is a debit balance, credit balance or Nil
2.6 The Customer Account Balance is the difference between the unsettled wagers made by the Customer and the sum of any Customer Deposits and unsettled winnings payable by Palmerbet for all settlement periods. If the unsettled wagers exceed the sum of Customer deposits and unsettled winnings, then there is a debit balance. If the sum of Customer Deposits and unsettled winnings exceed the unsettled wagers, then there is a credit balance.
2.7 In relation to Customers that have been granted a maximum debit limit the settlement period shall, unless otherwise agreed, be weekly and shall end at midnight on Sunday of any week with respect to wagers made by the Customer and accepted by Palmerbet during the preceding seven (7) day period.
2.8 In relation to Customer Betting Accounts without a Maximum Debit Limit, the Customer may request any credit balance be paid to it.
3 Settlement means the full payment of a Customer Account Balance for a settlement period and if there are unsettled Customer Account Balances for prior settlement periods then those prior settlement periods must be settled as well.
4 In relation to Customer Betting Accounts that have been granted a Maximum Debit Limit the Customer Account Balance is payable by the Customer in the case of a debit balance or, by Palmerbet in the case of a credit balance, and is payable immediately upon notification to the Customer by Palmerbet of a Customer Account Balance.
5 Where a Customer has been granted a Maximum Debit Limit in accordance with paragraph D, the Customer may be refused bets by Palmerbet if their Customer Account Balance at any time exceeds their Maximum Debit Limit or if the effect of that bet would cause the Maximum Debit Limit to be exceeded. If Palmerbet, in its discretion, allows a Customer to place a bet even though the Maximum Debit Limit may be exceeded, the Customer shall settle its resultant Customer Account Balance when next notified by Palmerbet.
6 For the avoidance of doubt, it is the Customer's responsibility to monitor the balance of their Customer Betting Account and if, for whatever reason, the Customer Betting Account Balance exceeds its Maximum Debit Limit it is the Customer's responsibility to ensure that all amounts of the Debit Balance are settled in accordance with theseTerms.
7 Where a Customer has not been granted a Maximum Debit Limit the Customer may be refused wagers by Palmerbet if their Customer Account Balance at any time is in debit or if the effect of any bet would cause the Customer Betting Account going into debit.
1 Any instructions received by Palmerbet from the Customer for the placing of Bets shall constitute acceptance of the terms contained herein.
2 Upon acceptance of these terms by the Customer the terms are irrevocable and can only be rescinded in accordance with these terms or with the written consent of the manager of the Palmerbet.
3 None of the Palmerbet's agents or representatives are authorised to make any representations, statements, conditions or agreements not expressed by the manager of the Palmerbet in writing nor is the Palmerbet bound by any such unauthorised statements.
4 The Customer undertakes to give the Palmerbet not less than fourteen (14) days prior written notice of any proposed change in the Customer's name and/or any other change in the Customer's details (including but not limited to, changes in the Customer's address, facsimile number, or telephone number).
5 Palmerbet reserves the right to void any or all bets made by any individual or group of people acting together (or on behalf of another individual or group of people) in an attempt to gain financial benefit through the manipulation of TOTE based dividends or official starting prices. This can include persons, relatives, organisations, Palmerbet and its employees.
13. PALMERBET ACCOUNT CREDIT BETTING TERMS AND CONDITIONS
Introduction to Palmerbet Credit Betting Terms
Palmerbet recognises that a credit facility attached to your Palmerbet Account can offer customers greater flexibility when betting, whilst still betting responsibly. Palmerbet may therefore offer you a credit betting facility attached to your Palmerbet account, which you may choose to accept or reject, or you may apply for a credit betting facility.
A. Obtaining a Credit Betting Facility
1. As a Palmerbet Account holder you may obtain a Credit Betting Facility attached to your Palmerbet Account, by:
(a) Palmerbet conditionally offering the Customer a Credit Betting Facility (which the Customer may accept or reject), subject to Palmerbet being satisfied with the Customer's financial capacity; or
(b) by you applying for a Credit Betting Facility via www.palmerbet.com.
2. So that Palmerbet can be reasonably satisfied that you have the financial capacity to repay the amount of credit owing on your Credit Betting Facility in accordance with the Settlement provisions in these Credit Betting Terms and Conditions, Palmerbet will have regard to:
(a) your identification verification;
(b) your creditworthiness, credit rating and/or your credit history based on an independent credit reporting agency reports ("CRA");
(c) your betting turnover with Palmerbet;
(d) your warranty that the financial and related information provide to Palmerbet at the time Palmerbet assesses your financial capacity is true, accurate and complete; and/or
(e) any written statement from your accountant that certifies that your financial and related information provided to Palmerbet is true, accurate and complete as at the date of your application for a Credit Betting Facility.
3. In order for Palmerbet to assess your financial capacity, you consent to Palmerbet:
(a) obtaining your credit report or any information about your creditworthiness, credit standing, credit history or credit capacity from an independent CRA;
(b) will disclose to any one or more independent CRAs, your personal information; or
(c) exchanging information with other credit providers about application for consumer/commercial credit.
4. You warrant and represent that any information supplied by you or on your behalf by an authorised third party (such as your accountant or banker) in your application for a Credit Betting Facility is true, accurate and complete as at the time of your application.
5. Palmerbet may choose to approve or decline your application for a Credit Betting Facility at its sole discretion. If your application is approved, you will be granted a notified credit limit. The credit limit may be less than initially applied for by you. Palmerbet will be under no obligation to disclose its reasons for declining an application or offering a Credit Betting Facility with a credit limit lower than applied for by you, unless required by law.
6. You agree that by obtaining a Credit Betting Facility (and any increase in such a Facility) that you have accepted these Credit Betting Facility Terms and Conditions and agree to be bound by these Terms and Conditions.
B. Customers to Notify Palmerbet of Material Change in Financial Capacity
1. You warrant that you will notify Palmerbet promptly, if at any time after being granted a Credit Betting Facility or any increase to such a Facility, you have a material adverse change in your financial capacity compared to such capacity at the time of your most recent application for a Credit Betting Facility or any increase in such a Facility.
2. You agree that any such notification by you of a material adverse change in your financial capacity, Palmerbet may withdraw your Credit Betting Facility or reduce the credit limit of your Credit Betting Facility, and notify you accordingly.
3. If you fail to notify Palmerbet of any adverse material change in your financial capacity, and Palmerbet becomes aware of such material change, Palmerbet may:
(a) withdraw your Credit Betting Facility or reduce credit limit, and notify you accordingly; or
(b) seek to recover any loss or damage suffered by Palmerbet caused or contributed to by your failure to so notify Palmerbet of such a material adverse change; or
(c) restrict, suspend or close your Palmerbet Account; or
(d) a combination of any of the above.
C. Settlement and Default of Settling
1. You must settle in full the amount of credit owed by you against your Credit Betting Facility ("Amount Owed") at 11.59pm on the first Sunday from the activation of the Credit Betting Facility and every Sunday at 11:59pm thereafter (“Settlement Date”), unless otherwise agreed in writing by Palmerbet prior to any Settlement Date.
2. You may settle your Amount Owed by payments to your Palmerbet Account by credit card, BPAY, POLi, cheque or EFT and that:
(a) You agree that if you make a deposit to your Palmerbet Account by cheque and any such cheque is dishonoured, then Palmerbet may debit your Palmerbet Account a fee of up to $16.50 (including GST) per dishonoured cheque; and/or
(b) If payment is by credit card, you must provide complete details of the credit card to be used by Palmerbet to pay the Amount Owed each Settlement Date, until such time that you provide written notice to Palmerbet to cease using the credit card for settlement purposes.
3. Should you fail to pay the Amount Owed on the Settlement Date in according with these Palmerbet Account Credit Terms and Conditions, Palmerbet may:
(a) charge your credit card for the Amount Owed, unless your failure to pay relates to an amount in genuine dispute and that dispute has not yet been resolved;
(b) charge your Betting Account an administrative fee of up to $25 for each time that you default on paying the Amount Owed on each Settlement Date, to address time and resources used to contact you and make payment arrangements; and/or
(c) subject to clause C.4, suspend any funds and any Betting Accounts until the Amount Owed is paid in full.
(d) charge interest on overdue Settlements from the date when the payment became due until the date of payment at a rate of 2.5% compounding per calender month until the amount is paid in full.
4. If you remain in default by failing to settle the Amount Owed, then Palmerbet may:
(a) on day 7 of default, suspend your Betting Account also (if it hasn't already done so under clause C.3(c));
(b) on day 14 of default, terminate your Betting Account also; and
(c) thereafter take all necessary steps to recover the Amount Owed, including listing the default with CRAs, and if necessary, instituting court proceedings to recover the amount of the default, costs involved in recovering any overdue amounts and interest.
5. You may be unable to place bets if, at any time, your Credit Betting Facility exceeds the credit limit of your Credit Betting Facility. If Palmerbet, in its discretion, allows you to place a bet even though the placement of such a bet may result in the credit limit of your Credit Betting Facility being exceeded, you will pay the amount owed in excess of the credit limit of your Credit Betting Facility (being part of the Amount Owed) at the Settlement Date, or immediately upon written notification by Palmerbet to do so, whichever occurs earlier in time.
6. If you default in payment of any Settlement when due you agree to indemnify Palmerbet from and against all costs and disbursements it incurs including on a solicitor and own client basis and in addition all of the Palmerbet’s nominees costs of collection.
7. Notwithstanding anything to the contrary contained herein or any other rights which Palmerbet may have howsoever:
a. Where you are the owner of land, realty or any other asset capable of being charged, you agree to mortgage and/or charge all of your joint and/or several interest in the said land, realty or any other asset to the Palmerbet or its nominee to secure all amounts and other monetary obligations payable under the terms and conditions. You acknowledge and agree that Palmerbet or its nominee shall be entitled to lodge where appropriate a caveat, which caveat shall be released once all payments and other monetary obligations payable hereunder have been met.
b. Should Palmerbet elect to proceed in any manner in accordance with this clause and/or its sub-clauses, you shall indemnify Palmerbet from and against all its costs and disbursements including legal costs on a solicitor and own client basis.
c. You hereby irrevocably nominate constitute and appoint Palmerbet or its nominee as your attorney to execute mortgages and charges (whether registrable or not) including such other terms and conditions as Palmerbet or its nominee shall think fit in their absolute discretion against your joint and/or several interest in any land, realty or asset in favour of Palmerbet and in your name as may be necessary to secure your obligations and indebtedness to Palmerbet and further to do and perform all necessary and other acts including instituting any necessary legal proceedings, and further to execute all or any documents in Palmerbet’s absolute discretion which may be necessary or advantageous to give effect to the provisions of this clause.
2. Personal information may be used or disclosed:
(a) to enable Palmerbet to perform its obligations to Customers under these Terms and Conditions;
(b) to enable Palmerbet to ensure that Customers perform their obligations under these Terms and Conditions;
(c) to a credit reporting agency;
(d) to enable the recovery of debt;
(e) to maintain a credit information file on Customers;
(f) by Palmerbet to carry out its own credit assessment on Customers;
(g) for planning, research, promotion and marketing of Palmerbet's products and services;
(h) to organisations associated with the provision of Palmerbet's services, such as associated data centres, for marketing and analysis purposes;
(i) to a potential purchaser of, or investor or in, any business conducted by Palmerbet;
(j) to law enforcement agencies to assist in the prevention of criminal activities; or
(k) to government, sporting or racing regulators, departments and/or agencies.
E. Termination, suspension and amendment
Palmerbet may suspend, terminate, amend or make conditional a Credit Betting Facility at any time on reasonable notice to the Customer. Upon termination or suspension of a Credit Betting Facility Palmerbet may require payment of any outstanding Credit immediately thereafter, but will honour any settlement period described in clause C.1 where applicable, unless the termination or suspension is due to the Customer's material breach of the Credit Betting Terms and Conditions.
1. For the avoidance of doubt, it is the Customer’s responsibility to monitor the balance of Credit and to ensure that they comply at all times with these Credit Betting Terms and Conditions.
2. Palmerbet may, in its discretion, give conditionally or withhold any approval or consent under these Credit Betting Terms and Conditions.
3. A Customer may only assign its rights under these Credit Betting Terms and Conditions with the prior written consent of Palmerbet.
4. Any term by its nature intended to survive termination of these Credit Betting Terms and Conditions survives termination.
5. Palmerbet does not waive a right, power or remedy if it fails to exercise or delays in exercising the right, power or remedy. A single or partial exercise of a right, power or remedy does not prevent another or further exercise of that or another right power or remedy.
